By using Banano, you agree to these Terms of Service. If you do not agree to these terms, please do not use our application.

Service Description

Banano is an AI-powered image generation application. You can generate images from text prompts, transform reference photos using curated style packs, and save your creations to a personal gallery. Generation is performed by third-party AI models; individual outputs may vary.

User Accounts

• You can use Banano with an automatically-created anonymous account, or sign in with email or a supported social provider. Anonymous accounts can be linked to a real account at any time from app settings.
• You are responsible for maintaining the security of your device and any credentials you use to sign in
• One account per user is permitted
• We reserve the right to terminate accounts that violate these terms

Acceptable Use

You agree NOT to use Banano to:

• Generate illegal, harmful, or offensive content
• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload reference photos containing other people's faces or likenesses without their explicit consent
• Generate content depicting real individuals without consent
• Create misleading or fraudulent content, including deepfakes intended to deceive
• Attempt to reverse engineer or hack the service

User Responsibility

You are solely responsible for:

• All content you create or upload using Banano
• Ensuring you have the right to use any images, faces, or likenesses in your prompts
• Not creating content that could harm, defame, or embarrass others
• Obtaining consent before generating images of real people
• Any legal consequences arising from your generated content
• Not using the service to impersonate others or create deepfakes

You agree to indemnify Banano from any claims arising from content you create.

Content Ownership

• You retain ownership of the prompts you provide
• Generated images are owned by you, subject to the AI model's license
• You grant us a license to store and process your content for service operation
• We may use anonymized data to improve our services

Credits and Purchases

• Credits (Bananas) are used to generate images
• Different image qualities consume different amounts of credits
• Purchased credits do not expire
• All purchases are final and non-refundable except as required by law
• Prices may change with notice

Disclaimers

• The service is provided "as is" without warranties
• We do not guarantee continuous, error-free operation
• Generated content may not always meet expectations
• We are not responsible for user-generated content
• AI-generated content may contain inaccuracies

Limitation of Liability

To the maximum extent permitted by law, Banano shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the service.

Indemnification

You agree to indemnify and hold harmless Banano from any claims, damages, or expenses arising from your use of the service or violation of these terms.

Termination

We reserve the right to terminate or suspend your account at any time for violation of these terms. You may delete your account at any time through the app settings.

Changes to Terms

We may update these Terms of Service from time to time. Continued use of the service after changes constitutes acceptance of the new terms.

Governing Law

These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Nothing in these terms removes any mandatory consumer-protection rights you have under the laws of the country in which you live; those rights continue to apply alongside these terms.
